Article 1 — Definitions

We, us, our: PlushTree, as identified above. You, the consumer: a natural person acting for purposes outside their trade, business, craft or profession. Agreement: the distance contract formed between you and us. Withdrawal period: the period during which you may withdraw from the agreement without giving a reason. Durable medium: any means allowing information to be stored and reproduced unchanged, such as email.

Article 2 — Applicability

2.1 These terms apply to every offer we make and every agreement we conclude at a distance.

2.2 We make these terms available to you electronically before the agreement is concluded, in a form you can save and print. They are also published on this website at all times.

2.3 Where a specific written agreement between us conflicts with these terms, the specific agreement prevails. Where these terms conflict with your mandatory statutory rights, those rights prevail.

2.4 The agreement can be concluded in Dutch or in English.

Article 3 — Prices, product information and images

3.1 All prices shown are in euros and include Dutch VAT. Delivery costs are shown separately and are confirmed at checkout before you pay. The total payable, including delivery, is always shown before you place the order.

3.2 We do not personalise prices using automated decision-making. Every customer sees the same price for the same product.

3.3 Offers are valid while stated and while stock lasts. Obvious errors or mistakes in an offer do not bind us.

3.4 Our product images are intended to be a faithful representation of the goods. However, colours as they appear on your screen may differ from the actual product, because screens, operating systems and display settings reproduce colour differently. We cannot accept responsibility for colour differences caused by your display. If the colour you receive is not what you expected, your right of withdrawal under Articles 6 to 9 applies in full.

3.5 Product dimensions are nominal. Natural cotton may vary slightly in size after washing; this is a property of the material, not a defect.

Article 4 — Formation of the agreement

4.1 The agreement is concluded when you place an order and we confirm it.

4.2 The order button is labelled so that it is clear that placing the order creates an obligation to pay.

4.3 We confirm your order by email without delay. That confirmation is on a durable medium and includes these terms, the information about your right of withdrawal, and the model withdrawal form set out in Annex I.

4.4 We may decline an order, or cancel it before dispatch, where a product is unavailable, where an obvious pricing error has occurred, or where we have reasonable grounds to doubt that the order is genuine. If we do, we tell you promptly and refund any payment in full.

Article 5 — Delivery

5.1 We deliver to the countries listed in our Shipping policy. Delivery addresses outside those countries cannot be accepted.

5.2 We aim to dispatch within 1–2 business days. Delivery estimates are given in good faith and are not guaranteed dates.

5.3 We will deliver within 30 days of the agreement at the latest, unless we have agreed otherwise with you. If we cannot, you may cancel the agreement free of charge and we will refund you within 14 days.

5.4 Risk of damage or loss passes to you when you, or a third party you nominate other than the carrier, take physical possession of the goods.

Article 6 — Your right of withdrawal

6.1 You have a statutory right to withdraw from the agreement within 14 days, without giving any reason.

6.2 We voluntarily extend that period to 30 days, on the same terms. Everything in Articles 6 to 9 applies to the full 30 days.

6.3 The period starts on the day after you, or a third party you nominate other than the carrier, take physical possession of the goods. Where an order is delivered in several shipments, it starts on the day after you receive the last item.

6.4 If we have not informed you of your right of withdrawal, the period ends 12 months after the end of the original period. If we provide that information within those 12 months, the period ends 14 days after the day you receive it.

Article 7 — Your obligations during the withdrawal period

7.1 During the withdrawal period, please handle the goods with care. You may unpack and handle them only as far as is necessary to establish their nature, characteristics and functioning — the same as you would be able to do in a shop. Unfolding a duvet cover to check its colour, size and feel is expressly permitted.

7.2 You are liable for any diminished value resulting from handling that goes beyond that. Washing, laundering or sleeping on bedding goes beyond it.

7.3 Where we reduce a refund for diminished value, we will tell you why and by how much. Circumstances in which we may do so include items that have been washed, items showing clear signs of use, pet hair or persistent odours, a set returned incomplete, and missing original packaging.

7.4 A reduction for diminished value is not a refusal of your return. We will not refuse a return because the packaging has been opened.

Article 8 — How to withdraw, and who pays

8.1 To withdraw, tell us within the period in Article 6. You may use the model form in Annex I, the withdrawal function on our website, or any other unambiguous statement — an email to support@plushtree.com is enough. You do not need to give a reason and you do not need an account.

8.2 The burden of proving that you withdrew in time rests with you, so please keep your confirmation.

8.3 After telling us, you have a further 14 days to send the goods back.

8.4 Returns are free. We bear the direct cost of returning the goods. We will email you a prepaid return label, which you print and attach before dropping the parcel off. If you prefer to arrange your own carrier instead, you bear that cost. Our registered address is not a collection point; please do not send a return without telling us first.

8.5 If you withdraw, any related agreement is terminated by operation of law.

Article 9 — Our obligations on withdrawal

9.1 We confirm receipt of your withdrawal without delay, on a durable medium.

9.2 We refund you within 14 calendar days of the day we are informed of your withdrawal, using the same payment method you used, at no charge to you.

9.3 We may withhold the refund until we have received the goods back, or until you have shown proof that you have sent them, whichever comes first.

9.4 We refund the standard delivery cost you paid on the original order. If you chose a more expensive delivery option than our standard one, we refund the standard cost only.

Article 10 — When the right of withdrawal does not apply

10.1 The right of withdrawal does not apply to:

  • goods made to your specification or clearly personalised;
  • goods supplied in a sealed hygiene wrapper, where that seal has been broken after delivery and the goods cannot for reasons of health protection or hygiene be returned.

10.2 An exclusion applies only where we have clearly stated it in the offer, or in good time before the agreement is concluded.

Article 11 — Payment

11.1 Payment is due at the time of ordering, through the methods shown at checkout.

11.2 You must report any inaccuracy in payment details supplied to us without delay.

11.3 Where you owe us a sum after withdrawal, damage or late payment, statutory rules on default interest and collection costs for consumers apply.

Article 12 — Conformity and guarantee

12.1 We guarantee that the goods conform to the agreement, to the specifications stated in the offer, and to reasonable requirements of soundness and usability.

12.2 You have a statutory right to goods that conform to the agreement. If they do not, you may require repair or replacement, and in certain cases a price reduction or termination of the agreement. These rights are free of charge and exist independently of any commercial guarantee.

12.3 Nothing in these terms limits or excludes those statutory rights.

12.4 Normal wear, damage caused by improper use, and failure to follow our care instructions are not defects.

Article 13 — Complaints

13.1 If something is wrong, tell us. Describe the problem fully and clearly and send it to support@plushtree.com, or call us. Please do so within a reasonable time of discovering it.

13.2 We reply within 14 days. If we need longer to investigate, we will acknowledge your complaint within that time and tell you when you can expect a substantive answer.

13.3 If we cannot resolve the complaint together, you may bring the dispute before the competent court. We are not currently a member of a certified alternative dispute resolution scheme. Dutch and Belgian consumers can obtain free, independent information about their rights from ConsuWijzer, the consumer information service of the Netherlands Authority for Consumers and Markets (ACM).

Article 14 — Retention of title

14.1 Goods remain our property until you have paid for them in full. This does not affect the passing of risk under Article 5.4.

Article 15 — Personal data

15.1 We process personal data in accordance with our Privacy policy and applicable data protection law.

Article 16 — Final provisions

16.1 Dutch law applies to these terms and to every agreement between us. This choice does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.

16.2 Disputes will be submitted to the competent court, without prejudice to your right as a consumer to bring proceedings in the courts of the country where you reside.

16.3 If any provision of these terms is found to be void or unenforceable, the remainder stays in force and the provision concerned is replaced by one that comes closest to its intended meaning.

16.4 We may amend these terms. The version in force when you place your order is the version that applies to that order.

16.5 These terms are drawn up in Dutch. This English text is a translation for convenience; in the event of any discrepancy, the Dutch text prevails.
